If you are dissatisfied with any portion of the Website, your sole and exclusive remedy is to discontinue use of the Website. Our aggregate liability to you for all claims arising from or related to the Website, Egasm™ Products, and/or Egasm™ Content is limited to the lesser of the fees paid by you to the Website or its operators for services provided on the Website or fifty dollars ($50).

13. Exclusions and Limitations

Some jurisdictions do not allow the exclusion of certain warranties or the limitation or exclusion of liability for incidental or consequential damages. Prices for products offered on the Website are subject to change without notice.

16. Intellectual Property

Nothing contained on the Website or in these Terms shall be construed to grant any property rights, by license or otherwise, to any invention, patent, copyright, trademark, or other intellectual property rights owned by the operators of this Website, Concordia Partners, or its partners or affiliates. All images, text, custom graphics, button icons, the collection and compilation and assembly thereof, and the overall look and distinctiveness of the Website constitute trade dress and are the property of Concordia Partners. Any use of such trademarks, service marks, registered or pending, and/or trade dress without the prior written consent of Concordia Partners is expressly forbidden. Any other trademarks or service marks appearing anywhere on this site are the property of their respective owners.

The Website and all images, text, databases, software, code, sound, photos, custom graphics, button icons, the collection and compilation and assembly thereof, and the overall look and distinctiveness of the Website are the exclusive property of Concordia Partners and its licensors and are protected by U.S. and international copyright laws.

The Egasm™ Content on the Website may be used for informational purposes only. Any other use of the Egasm™ Content on the Website without the prior written consent of Concordia Partners is expressly forbidden.

We reserve the right to terminate access to the Websites of any user who infringes the proprietary rights of any third party.

17. Dispute Resolution

Any claim, dispute, or controversy arising out of the Terms, the Privacy Policy, the services provided on the Website, or the Egasm™ Content ("Claims") shall be resolved by final and binding arbitration before a single arbitrator ("Arbitrator") selected from and administered by the American Arbitration Association in accordance with its applicable rules. The arbitration hearing shall be held in Portland, Maine. The prevailing party shall be entitled to reimbursement from the other party of its reasonable attorney's fees, costs, and disbursements arising out of the arbitration. Either you or Concordia Partners may seek interim or preliminary injunctive relief from a court of competent jurisdiction Portland, Maine, as necessary to protect the rights or property of you or Concordia Partners pending the completion of any arbitration proceeding.

18. General

The Terms constitute the entire and exclusive and final statement of the agreement between us with respect to the subject matter hereof, and govern your use of the Website superseding any prior agreements or negotiations between you and Concordia Partners with respect to the subject matter hereof. The Terms and the relationship between you and Concordia Partners shall be governed by the laws of the State of Maine, without giving effect to any choice of laws or principles that would require the application of the laws of a different country or state.

Our failure to exercise or enforce any right or provision of the Terms shall not constitute a waiver of such right or provision. If any provision of the Terms is found to be invalid by either a court of competent jurisdiction or the Arbitrator, you nevertheless agree that the court or the Arbitrator should endeavor to give effect to your and our intentions as reflected in the provision, and that the other provisions of the Terms remain in full force and effect.

You agree that, regardless of any statute or law to the contrary, any claim or cause of action arising out of or related to use of the Services or the Terms must be filed within one (1) year after such claim or cause of action arose or be forever barred.

The section titles in the Terms are for convenience only and have no legal or contractual effect. Sections 6 through 17 shall survive any expiration or termination of the Term
